FOB Shipping Point: Standard terms: 50% down with signed quote and 50% before shipment.

Quotation valid for 5 days. All bonds and permits are the responsibility of the customer.

Optional Installation: The customer is responsible for unloading freight prior to installer’s arrival. Note: Any delays caused by the customer’s company will be billed at $105 per hour per installer. These charges may be evolved by maintaining close communications with the lead installer. The area must be clear and ready for installation. The customer must provide a FORKLIFT and SCISSOR LIFT during installation if possible.

Terms of Sale: All sales of used , refurbished and custom fabricated products are final. A photo of product can be supplied upon request for customer approval. Returns of standard new items require prior authorization and will be subject to a 25% restocking fee. All pre authorized returns must be shipped freight prepaid by customer. Returns will not be accepted collect or 3rd party billing. Returns accepted up to 30 days for in house merchandise credit only. Used and refurbish equipment is sold “AS IS WHERE IS” and is subject to prior sale where applicable. A service charge of 1-1/2% per month or the maximum allowed by law, on the unpaid balance will be charged on all accounts not paid to our terms and specified. Buyers agrees to pay reasonable attorney’s fees should contract be referred to an attorney for collection.

This agreement shall be governed by and construed in accordance with the laws of the state of Florida. The parties hereby consent to jurisdiction and venue in Hillsborough county, Florida and agree that such jurisdiction and venue shall be sole and exclusive for any and all actions or disputes related to this agreement or any related instruments. In the event of any litigation between the parties arising out of this agreement or the collection of any funds due buyer or seller pursuant to this agreement, the prevailing party shall be entitled to recover all costs incurred, including without limitation reasonable attorney’s and paralegal fees and costs, whether fees and costs and incurred at trial, on appeals or in bankruptcy proceedings. Customer is responsible for remittance or any/all sales and use (or similar) tax not separately stated.
